Welcome to gChat and the appsPride ecosystem (including ChatGay.pt). These Terms and Conditions govern access to and use of our chat services, websites, and associated multimedia platforms.
1. Scope and Purpose
gChat is a real-time online communication platform strictly for adults, providing public chat rooms, private direct messaging, media sharing, and WebRTC video calls operated by appsPride.
2. Sole User Responsibility for Messages & Multimedia (Full gChat Exemption)
The transmission, sharing, sending, and reception of any text messages, photographs, videos, audio recordings, or live video streams is the sole and exclusive responsibility of the user who sends or shares them.
Full Exemption of gChat: gChat, appsPride, its founders, and operators are completely extraneous and exempt from any civil, criminal, or moral liability regarding the content, opinions, photographs, videos, or media exchanged between users.
Passive Technical Intermediary: gChat operates strictly as an intermediary technical hosting and data transmission provider without prior editorial control or pre-screening of user-generated content.
Ownership & Legality: Users represent and warrant that they possess all required rights or permissions for any media they transmit, assuming full liability for any third-party claims or legal violations.
3. Mandatory 18+ Age Requirement
The service is strictly intended for individuals aged 18 years or older. Access by minors is strictly prohibited. By accessing gChat, you certify that you are at least 18 years old.
4. Automated Moderation & AI (appsPride Safe & DSA)
Under the EU Digital Services Act (DSA), gChat employs the appsPride Safe moderation engine to detect illegal content, fraud, harassment, and child exploitation. Users have the right to request human review of automated moderation actions via gchat@appspride.com.
5. Disciplinary Sanctions
Warning & Content Removal: Removal of offending messages or media.
Temporary Ban (1 Hour): Standard automated temporary suspension for minor/moderate rule violations.
Permanent Ban: Definite termination of access and device/IP blocking for severe, criminal, or repeated violations.
6. Zero Tolerance for Child Exploitation
Any content, solicitation, or grooming involving minors (CSAM/CSAE) results in immediate permanent ban, technical data preservation, and reporting to law enforcement authorities.
7. Video Calls & Media Rules
Non-consensual recording, taking screenshots, or distributing intimate media of other users is strictly prohibited. Live video calls are peer-to-peer (WebRTC) and not recorded on appsPride servers.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of Portugal and the European Union, with exclusive jurisdiction in Portuguese courts.
